These Terms of Service ("Terms") govern your use of the Swivo platform, including our website, dashboard, and related services. By creating an account or using Swivo, you agree to these Terms. If you do not agree, please do not use our services.
To use Swivo, you need to create an account with a valid email address and a secure password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you believe your account has been compromised, please contact us immediately at hello@swivoapp.com.
Swivo offers paid subscription plans billed on a monthly basis. By subscribing, you authorize us to charge your payment method each billing cycle until you cancel. You can upgrade, downgrade, or cancel your plan at any time from the Billing section of your dashboard. Cancellations take effect at the end of your current billing period, and you will retain access to your plan's features until that date.
Gift costs are separate from your subscription fee. When you place an order through a fulfillment partner like SweetSway, those charges are processed independently.
You may use Swivo for lawful business and professional purposes. You agree not to misuse the platform in any way, including but not limited to: attempting to access another user's account, using automated tools to scrape or collect data from our platform, uploading malicious content, or using Swivo to send unsolicited communications to recipients who have not consented.
You retain ownership of all data you provide to Swivo, including recipient information, company details, and order history. We do not claim any rights to your content. By using the platform, you grant us permission to store, process, and display your data solely for the purpose of providing our services to you.
Swivo facilitates gift orders but does not manufacture, ship, or deliver physical products. Orders placed through the recommended partner, SweetSway, are fulfilled by SweetSway according to their own policies. For custom vendor orders, you are responsible for managing fulfillment directly with your chosen vendor. Swivo is not liable for delays, damages, or issues related to the physical delivery of gifts.
You may delete pending orders from your Order Queue at any time. For orders fulfilled through SweetSway, cancellations must be made within 24 hours of placing the order. After that window, please contact SweetSway directly to arrange a cancellation.
We strive to keep Swivo available at all times, but we cannot guarantee uninterrupted service. We may occasionally need to perform maintenance, and we reserve the right to modify, update, or discontinue features of the platform. We will provide reasonable notice for significant changes whenever possible.
Swivo is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied. We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform, including but not limited to lost profits, data loss, or business interruption. Our total liability for any claim related to our services shall not exceed the amount you paid for your subscription in the 12 months preceding the claim.
You may close your account at any time by contacting us. We may also suspend or terminate your account if we believe you have violated these Terms. Upon termination, your right to use Swivo ends immediately, and we will delete your data in accordance with our Privacy Policy.
We may update these Terms from time to time. When we make changes, we'll update the date at the top of this page. For material changes, we'll notify you by email. Continued use of Swivo after changes are posted constitutes acceptance of the updated Terms.
